What Steps Should Be Taken After a DUI Arrest

As a Sarasota DUI lawyer, I am often asked what steps should be taken when one is arrested for Driving Under the Influence (DUI). Any arrest is a traumatic and negative experience. However, a DUI arrest has consequences that, if you do not act fast and regardless of the ultimate outcome of your case, your livelihood will be immediately impacted. Remember these easy steps:

  • Call a lawyer experienced in DUI and traffic tickets immediately. Getting arrested for a DUI is not the time to "go-it-alone" in order to save money. You risk long-term driver license suspension, probation, jail and other criminal fines. An experienced lawyer will evaluate your case and prepare your defense.
  • If you are able, post the monetary cash bond or hire a bond company to post bond for you. If you cannot afford to post monetary bond, the Judge at first appearance will most likely place you on Supervised Release (SPR). The Judge can impose additional special conditions such as curfews, check-ins with a SPR officer, and/or random drug and alcohol testing. This program in addition to being an imposition on your employment will cost you additional money, and the restrictions will remain in place until your case is decided. In many cases this could be several months to a year.
  • Apply to the Florida Department of Highway Safety and Motor Vehicles (DHSMV) for a temporary extension of your driving privilege within 10 days of arrest or if you are eligible a waiver of your administrative review. In order for you to get a waiver your lawyer will advise you of the necessary steps that ALL must be taken within 10 days of the arrest. If not, they are waived forever and your suspension will go into effect immediately.
  • Finally, make your lawyer aware of any Civil Citations you may have received. Do not pay those tickets until you consult fully with your experienced DUI lawyer. In most cases these tickets can be merged with your criminal case and ultimately dismissed by the Judge. Following these simple steps will ensure that you will significantly lessen the impact of receiving a DUI.
